Terms of Service

These Terms of Service govern access to and use of Makecard. By using Makecard, you agree to these Terms.

1. Service

Makecard provides a digital loyalty card platform for businesses and their customers.

2. Eligibility

You must be legally able to enter into a binding agreement to use Makecard. If you use Makecard on behalf of a business, you confirm that you are authorized to act for that business.

3. Accounts

You are responsible for:

• Providing accurate account information
• Keeping your login credentials secure
• All activity that occurs under your account

You must notify us promptly if you believe your account has been accessed without authorization.

4. Acceptable use

You must not:

• Use Makecard for unlawful, misleading, fraudulent, or harmful activity
• Interfere with or disrupt the service
• Attempt unauthorized access to accounts, systems, or data
• Copy, reverse engineer, or exploit the service beyond what is permitted by law
• Use Makecard to send spam or misuse customer information

5. Business responsibility

If you are a business using Makecard, you are responsible for:

• Your loyalty program settings, rewards, and customer-facing claims
• Your compliance with applicable privacy, marketing, and consumer laws
• Your use of customer information collected through the platform

6. Customer use

If you use a loyalty card provided through Makecard, the business offering that card is responsible for its rewards, rules, and redemption decisions. Makecard provides the platform only.

7. Fees and billing

Paid use of Makecard may require subscription fees. Pricing, trial terms, and promotional terms may be presented separately. Unless stated otherwise:

• Fees are billed in advance
• Fees are non-refundable except where required by law
• We may change pricing with reasonable notice for future billing periods

8. Availability

We aim to keep Makecard available and working properly, but we do not guarantee uninterrupted or error-free service. We may modify, suspend, or discontinue parts of the service at any time.

9. Intellectual property

Makecard and its underlying software, branding, and materials remain our property or the property of our licensors. These Terms do not give you ownership of the service.

You retain rights to content you upload, such as logos, subject to any rights needed for us to operate the service.

10. Termination

We may suspend or terminate access if you violate these Terms, create risk for the service, or use Makecard improperly. You may stop using the service at any time.

11. Disclaimer

Makecard is provided on an “as is” and “as available” basis to the extent permitted by law. We do not guarantee that the service will be uninterrupted, secure, error-free, or suitable for every business purpose.

12. Limitation of liability

To the maximum extent permitted by law, Makecard will not be liable for indirect, incidental, special, consequential, or loss-of-profit damages arising from use of the service. Our total liability for any claim relating to the service will be limited to the amount paid by you to us for the service in the 12 months before the claim, or a minimal amount if no fees were paid, to the extent permitted by law.

13. Changes

We may update these Terms from time to time. Continued use of Makecard after updated Terms take effect means you accept the updated Terms.
